'piracy' update

wow– now they're getting formal (and REALLY nasty) about it: they are
insisting I remove the jpeg of Molotov from my website – and they
want thousands of dollars! AND they want my painting never to be
reproduced or exhibited again!

It seems the image on the website is a flashpoint; they're harrassing my
gallery about it too. As though anyone even looks much at our websites…
Maybe they will now.

anyone feel like grabbing the image and putting it on their site? not
that I'm actually suggesting it or anything (ahem). I may have to remove
it from mine at some point, even if only temporarily, to avoid 'problems.'

Why are they so afraid of the painting?
By the way has it been sold yet? What is it going for?

the painting is as yet unsold. my gallery thinks they are completely out
of line. I don't htink they are afraid of the painting so much as afraid
of the reproductions, especially those on the web. the web is the
photojournalist's nightmare…

oMG! that is amazing – I have to tell my lawyer about what's going on
(tomorrow afternoon). I'm actually feeling a bit down about it all today,
and my perspective is skewed. I LOVE that you would be willing to commit
to such an action and it makes me feel like if I really have to embark on
a joywar (smirk) you guys are behind me (chomping at the bit as it were).

so my sense is that joywar has not yet been declared, but rallying the
troops is in order…

Well no doubt in my mind, anyone reading this particular lawyer's letters
would be outraged–that includes my own lawyer. Apparently talking to the
plaintiff's lawyer on the phone is no fun either – I've been
spared that experience.

plus, it's so much gobbledy-gook and case law thrown in, it's mostly
bombast and boring. 18 pages of boring.

I don't even want to divulge the identity of the plaintiff–I would like
to keep that quiet. She may be agressing me here, but I am only
interested in her leaving me alone–not smearing her. Imagine if I posted
her name on the list!

I'm actually more interested in our discussing the subject here in the
abstract as much as possible– it's an excuse for us to discuss these
issues, copyright, sampling, fair use, art, appropriation, yadayada–
the changing culture–these are OUR issues and it's important to address
them.

Anyway, I would be really happy if both parties resolved this load of crap
they're throwing at me and didn't have to spend the money in court
(it's expensive enough right now– I would need a defense fund if it
wwent to trial) –even though they don't have a solid case, even if I were
to win, it would still be a nightmarish, exhausting and ultimately
wasteful experience.

If it all goes "public" however–if they go forward with the injunction
–then it's public information and everyone gets to know the who and
what of it… and report on what they know.

Groklaw does a good job of it. It can be informative and bring people
togetehr (not to mention be cathartic) to see what actually goes on.

You can always white-out the photographer's name if you're worried
they'll get mailbombed. :-)
